IP Ownership Policy

The following ruling aligns with the NSW Health Policy Directive (PD2023_007).

Where commercialisation is sought, it is to be to be shared between the creators of the IP, the department or section of the public health organisation which originated the IP, and the public health organisation on a 1/3, 1/3, 1/3 basis.

SCHN distribution philosophy for net income, which is the income after commercialisation costs have been deducted, is as follows:

  • 1/3 SCHN (IP Committee Budget)
  • 1/3 Division/Program (Innovation Budget)
  • 1/3 Inventor (personal use)

An individual must contribute to the conception of the final form, or have modified the originally conceived ideas, to be considered the inventor. Ownership of patent rights vests in the Inventors (not contributors), and if created in the course of employment, in the inventor’s employer (SCHN).
